By accessing or using DIY Your Quiz ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

DIY Your Quiz is a platform that allows users to create, share, and analyze personality quizzes. We provide tools for quiz creation, customization, distribution, response analytics, AI-powered image generation, AI-generated personality reports, gamification features (XP, levels, badges, leaderboards), quiz import from external sources, and result sharing features.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You may sign up using Google OAuth or email verification (OTP code).
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. User Content

4.1 Your Content

You retain ownership of the quizzes and content you create using our Service. By using our Service, you grant us a license to host, store, and display your content as necessary to provide the Service. AI-generated images created through our Service are licensed to you for use within the platform.

4.2 Imported Content

When importing quiz content from external sources (such as ChatGPT), you are responsible for ensuring you have the right to use such content and that it complies with these terms.

4.3 Content Guidelines

You agree not to create quizzes or content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Is defamatory, obscene, or invasive of privacy
• Infringes on intellectual property rights
• Contains malware, spam, or deceptive content
• Collects personal information without proper consent
• Attempts to abuse AI generation features or circumvent usage limits
• Attempts to manipulate gamification features or leaderboard rankings
• Violates any applicable laws or regulations

5. Quiz Participants

As a quiz creator, you are responsible for ensuring that your quizzes comply with applicable laws and respect the privacy of participants. If you collect email addresses or other personal information through quizzes, you must have a proper legal basis and provide appropriate disclosures.

6. Service Tiers and Payments

6.1 Free Tier

The free tier includes features as described on our pricing page, including quiz creation, analytics, draft/preview mode, quiz import functionality, gamification features, and AI personality reports for quiz takers. We reserve the right to modify free tier limitations at any time.

6.2 Paid Subscriptions

Paid subscriptions are billed in advance on a monthly basis. Pro features include AI image generation (with monthly limits), CSV export, and increased quiz limits. You may cancel your subscription at any time, and it will remain active until the end of the current billing period.

6.3 AI Generation Limits

Pro users receive a monthly allocation of AI image generations. Unused generations do not roll over to the next month. Generation limits reset on the first day of each month (UTC).

6.4 Refunds

Refund requests will be considered on a case-by-case basis. Please contact us if you believe you are entitled to a refund.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by DIY Your Quiz and is protected by intellectual property laws. You may not copy, modify, or distribute our platform or create derivative works without our permission.

9. Termination

We may terminate or suspend your account at any time for violations of these terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated content (images and personality reports) is provided for informational and entertainment purposes only.

11. Limitation of Liability

To the fullest extent permitted by law, DIY Your Quiz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless DIY Your Quiz and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes by posting a notice on our website or sending an email. Your continued use of the Service after changes constitutes acceptance of the modified terms.

14. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
